END-USER LICENSE AGREEMENT (EULA)

1. "AS IS" WARRANTY DISCLAIMER
The software is provided "as is" and "with all faults," without warranty of any kind. To the maximum extent permitted by applicable law, the Developer disclaims all warranties, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The entire risk as to the quality and performance of the software is with you.

2. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, in no event shall the Developer be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of confidential or other information, business interruption, personal injury, loss of privacy, failure to meet any duty including of good faith or of reasonable care, negligence, and any other pecuniary or other loss whatsoever) arising out of or in any way related to the use of or inability to use the software, even if the Developer has been advised of the possibility of such damages.

3. SPECIFIC DATA LOSS AND HARDWARE DISCLAIMER
You expressly acknowledge and agree that use of the software is at your sole risk. The Developer shall not be responsible for any damage to your computer system, hardware, software, or loss of data that results from the download, installation, or use of the software. You are solely responsible for maintaining independent backups of all data stored on your system.

4. REFUNDS
All sales of Nightscribe are final, and we do not offer refunds.

We apologize sincerely for any disappointment this may cause. Because a digital license can be purchased, downloaded, and retained with such ease — and because the Software Key unlocks lasting use of the product — we are unable to reverse a completed purchase once payment is confirmed. We ask that you review the product description carefully before buying, and we are grateful for your understanding.

Nothing in this section limits any non-waivable rights you may have under mandatory consumer-protection law that applies to you.
